The State of Arizona is questioning the definition of elder guardianship.  They are asking, “Is it elder care or elder abuse?”  Many people retire in Arizona because of the beautiful, warm climate.  However, those that have to live in a nursing home are not aware of the possible nightmares that they can have, especially if they have a guardian taking care of their business.

The Maricopa County Courtroom has had cases of elderly people being taken to nursing homes against their will and they were not allowed to have visitors, including their own family. A family cannot force a loved one to get medical help, but a court-appointed guardian can.  In one specific case, it was a guardian from the Sun Valley Group in Tempe.  They supposedly offer, “Support for client’s physical, social, emotional and mental health.”  They also take over all personal finances.  However, the Sun Valley Group did not get the individual medical help, did not pay her bills and allowed her home to go into foreclosure.  The group paid more attention to the her money, not her health.

If you have a guardian caring for a loved one and find he or she is caring mostly for your loved one’s money and not his or her health, I suggest you contact an experienced Elder Abuse Attorney who will investigate the matter for you.  An elderly person not only deserves love and proper attention, but he or she deserves respect.
